Probate is the court-supervised process of validating a will and managing the transfer of property outlined in the will. If the will is contested, it is done so during probate. Generally, contests to the will are raised by heirs who feel they are entitle to a larger share of the decedent’s property or those who believe the decedent was improperly influenced in making the will. These contests are litigated prior to the administration of the estate.

The Typical Probate Process

Most wills are not contested and the probate process primarily consists of collecting, probate assets and income, paying debts and taxes owed by the estate and distributing the remaining assets among the heirs. An executor (either named by the will or appointed by the court) settles the estate. Depending on the size and complexity of the estate, the probate process can take a considerable amount of time.
